Данная работа посвящена особенностям политико-правового положения саамов Финляндии и Швеции. В рамках исследования были решены следующие задачи: определить кто законодательно имеет право называться саамом; проанализировать статус саамского языка; дать оценку деятельности Парламента саамов; проанализировать судебный «Girjas mot staten»; определить проблемы политико-правового положения саамов в Финляндии и Швеции и возможные пути их решения. Предметом исследования являются законодательные акты, регламентирующие правовые основы гарантий развития саамов как малочисленного коренного народа. По итогам работы были сделаны следующие выводы: положение саамов в двух странах характеризуется культурной автономией, саамы имеют права использовать свой родной язык и заниматься развитием и сохранением своей культуры. Основной проблемой в положении саамов является отсутствие исключительных прав на землю и природные ресурсы. Для эффективной правовой защиты саамов и роста интереса к проблеме коренных народов необходим единый орган саамов, который являлся бы их представителем на международной арене и отстаивал их интересы. Данная работа будет полезна при разработке проекта данного органа и соответствующего законодательства, на основе которого тот будет осуществлять свою деятельность, т.к. содержит наиболее полный анализ законодательных актов.

The given work covers the features of the political and legal status of the Sami in Finland and Sweden. The following objectives were met in this research: to define who legally has the right to be called a Sami; to analyze the status of the Sami language and determine the level of government support for it; to define the role of the Sami representative body, the Sami Parliament, and assess its activity; to analyze an exceptional court case in Sweden «Girjas mot staten»; to identify the problems of the political and legal status of the Sami in Finland and Sweden and possible ways to solve them. The subject of the research is the legislation regulating the legal basis for guaranteeing the distinctive socio-economic and cultural development of the Sami as small indigenous peoples of Finland and Sweden. The following conclusions were drawn on the outcome of the research: the situation of the Sami in the two countries is characterized by cultural autonomy, the Sami have the rights to use their native language and engage in the development and preservation of their culture and traditional forms of economic management. The main issue in the situation of the Sami is the lack of exclusive rights to land and natural resources. For effective legal protection of the Sami and the growth of interest in the issue of indigenous peoples, a single Sami body is needed to represent them in the international arena and protect their interests. The given work will be useful in developing the draft of this body and the relevant legislation based on which it will carry out its activities since it contains the most complete analysis of legislative acts.
