Данная работа посвящена изучению механизма защиты прав хозяйствующих субъектов в сфере энергетики, анализу нормативных правовых актов и правоприменительной практики в данной сфере, выявлению проблемных вопросов и разработке рекомендаций по их решению. Задачи, которые решались в ходе исследования: 1. Определить особенности правового статуса хозяйствующих субъектов в сфере энергетики; 2. Выявить особенности механизма правового регулирования деятельности хозяйствующих субъектов в сфере энергетики; 3. Определить особенности защиты прав хозяйствующих субъектов в сфере энергетики; 4. Выявить процессуальные особенности рассмотрения арбитражными судами споров в сфере энергетики; 5. Проанализировать судебную практику в сфере энергетики; 6. Выявить проблемы защиты прав хозяйствующих субъектов в сфере энергетики; 7. Предложить варианты решения обозначенных проблем.
This work is devoted to the study of the mechanism for protecting the rights of business entities in the energy sector, the analysis of regulatory legal acts and law enforcement practice in this area, the identification of problematic issues and the development of recommendations for their solution. Tasks that were solved in the course of the study: 1. Determine the features of the legal status of economic entities in the energy sector; 2. To identify the features of the mechanism of legal regulation of the activities of economic entities in the energy sector; 3. Determine the features of protecting the rights of business entities in the energy sector; 4. Identify the procedural features of consideration by arbitration courts of disputes in the energy sector; 5. Analyze judicial practice in the energy sector; 6. Identify problems of protecting the rights of business entities in the energy sector; 7. Offer options for solving the identified problems.
