Тема выпускной квалификационной работы : «Система гарантий защиты конституционных прав человека и гражданина в Российской Федерации» Защита прав граждан является наиболее сложной общеправовой проблемой. Специфика данного вопроса состоит не столько в большом количестве концепций и теорий, посвященных правам человека, сколько в пренебрежении общепризнанными принципами и нормами их защиты в законодательной и правоприменительной практике. Гарантии прав человека в свою очередь, это условия и средства, обеспечивающие возможность пользоваться правами, установленными конституцией и другими законами. Однако, на сегодняшний день, очень многие условия, которые должны обеспечивать такую возможность, не действуют, или действуют на определенный круг лиц. Некоторые принимаемые законы противоречат уже действующим законам, а некоторые, содержат нормы, которые ограничивают ряд лиц в пользовании своими конституционными правами. Объектом исследования данной работы являются общественные отношения, возникающие и развивающиеся в процессе обеспечения конституционных гарантий прав человека в Российской Федерации. Предметом исследования выступает система общественных отношений, складывающаяся в сфере осуществления судебной власти в процессе функционирования суда как важнейшего института обеспечения возможности человеку и гражданину пользоваться правами, установленными Конституцией и другими законами. Целью данной выпускной работы является рассмотрение существующего законодательства, выявление противоречий, приводящих к возникновению проблем в области защиты прав граждан Российской Федерации и определение путей их разрешения, с учетом проходящих в стране реформ. Научное и практическое значение данной работы заключается в том, что анализ проблемы, поднятой в ней, и выводы из данного анализа призваны способствовать дальнейшему совершенствованию механизма реализации гражданами права на судебную защиту. Важной проблемой вопроса судебной защиты прав граждан, является проблема доступности такой защиты и право на бесплатную юридическую помощь. Так же , проблемой видится внесудебная защита прав человека. Действующая Конституция разрешает защищать свои права всеми способами, не запрещенными законом, что можно трактовать как право любого человека выбирать способ защиты своих прав.

The protection of citizens ' rights is the most complex General legal issue. The specificity of this issue is not so much a large number of concepts and theories on human rights, but rather a disregard for generally recognized principles and norms of their protection in legislative and law enforcement practice. Human rights guarantees, in turn, are the conditions and means that ensure the ability to enjoy the rights established by the Constitution and other laws. However, today, many of the conditions that should provide such an opportunity do not apply, or apply to a certain group of people. Some adopted laws contradict existing laws, and some contain provisions that restrict a number of individuals from exercising their constitutional rights. The object of this research is social relations that arise and develop in the process of ensuring constitutional guarantees of human rights in the Russian Federation.The subject of the research is the system of public relations that develops in the sphere of judicial power in the process of functioning of the court as the most important institution for ensuring the ability of individuals and citizens to enjoy the rights established by the Constitution and other laws. The purpose of this final work is to review existing legislation, identify contradictions that lead to problems in the protection of the rights of citizens of the Russian Federation and identify ways to resolve them, taking into account the ongoing reforms in the country. The scientific and practical significance of this work lies in the fact that the analysis of the problem raised in it, and the conclusions from this analysis are designed to further improve the mechanism for citizens ' exercise of the right to judicial protection.An important issue of judicial protection of citizens ' rights is the availability of such protection and the right to free legal assistance. The current Constitution allows you to protect your rights in all ways that are not prohibited by law, which can be interpreted as the right of any person to choose a way to protect their rights. However, the right to self-defense is quite new, since it was only established with the adoption of the Constitution, and its meaning is rather vague. Thus, in order to solve this problem and to be able to guarantee the right to judicial protection, or to be more precise, the right to access it, it seems necessary to expand the range of persons who can receive legal assistance free of charge, and to include in this list persons with disabilities of all groups, the poor, persons who have not reached the age of majority.
