Данная работа посвящена исследованию адвокатская тайны и вопросов ее гарантий в современном процессе. Цель работы заключается в изучении теоретико-правовые основ адвокатской тайны и раскрытии основных правовых черт ее гарантий в современном процессе. В работе рассматриваются: – теоретико-правовые основы адвокатской тайны, а именно понятие и сущность адвокатской тайны, историческое развитие института адвокатской тайны в Российской Федерации, а также международные стандарты защиты адвокатской тайны; – нормативно-процессуальные особенности адвокатской тайны в Российской Федерации, в частности концепт адвокатской тайны и обязанности адвоката по обеспечению адвокатской тайны в Российской Федерации, в том числе ответственность за ее нарушение, а также проблемы обеспечения адвокатской тайны в современном процессе Российской Федерации; – гарантии защиты адвокатской тайны в современном процессе, а именно охарактеризовать адвоката как гарант адвокатской тайны, профессиональное сообщество адвокатов и органы государственного регулирования в обеспечении адвокатской тайны, а также перспективы развития института адвокатской тайны. В результате в настоящей выпускной квалификационной работе выявляются основные проблемы гарантий адвокатской тайны в современном процессе, а также перспективы развития института адвокатской тайны.

This work is devoted to the study of attorney-client privilege and issues of its guarantees in the modern process. The purpose of the work is to study the theoretical and legal foundations of attorney-client privilege and to reveal the main legal features of its guarantees in the modern process. The paper considers: – the theoretical and legal foundations of attorney-client privilege, namely the concept and essence of attorney-client privilege, the historical development of the institute of attorney-client privilege in the Russian Federation, as well as international standards for the protection of attorney-client privilege; – regulatory and procedural features of attorney-client privilege in the Russian Federation, in particular the concept of attorney-client privilege and the duties of a lawyer to ensure attorney-client privilege in the Russian Federation, including responsibility for its violation, as well as the problems of ensuring attorney-client privilege in the modern process of the Russian Federation; – guarantees for the protection of attorney-client privilege in the modern process, namely, to characterize a lawyer as a guarantor of attorney-client privilege, the professional community of lawyers and government regulatory authorities in ensuring attorney-client privilege, as well as the prospects for the development of the institute of attorney-client privilege. As a result, this final qualifying paper identifies the main problems of guarantees of attorney-client privilege in the modern process, as well as the prospects for the development of the institute of attorney-client privilege.
