Тема выпускной квалификационной работы: «Рассмотрение споров о защите интеллектуальных прав в судах общей юрисдикции». Исследовательская работа посвящена изучению вопросов, связанных с рассмотрением споров о защите интеллектуальных прав в судах общей юрисдикции. Особое внимание уделяется вопросу компетенций судов общей юрисдикции в области защиты интеллектуальных прав, а также анализу материалов судебной практики, на примере которой исследуются проблемы, связанные с защитой интеллектуальных прав. Основными задачами работы являются: определение общей характеристики интеллектуальных прав, а также выявление основных видов интеллектуальных прав; исследование правового регулирование интеллектуальных прав по российскому законодательству и международным нормам; определение компетенций судов общей юрисдикции в разрешении споров о защите интеллектуальных прав, выявление особенностей рассмотрения дел о защите авторских, смежных прав и иных интеллектуальных прав; анализ судебной практики рассмотрения дел, связанных с нарушением интеллектуальных прав, определить роль экспертизы в области интеллектуальной собственности; исследование проблем, возникающих при рассмотрении споров о защите интеллектуальных прав в судах общей юрисдикции; определение перспектив развития института судебной защиты интеллектуальной собственности в российском законодательстве. Осуществлен анализ пробелов законодательства и проблем правоприменительной практики, на основании которых рассмотрены перспективы развития института судебной защиты интеллектуальных прав.

Theme of the graduate qualification work: “Consideration of disputes on the protection of intellectual rights in courts of general jurisdiction”. The research work is devoted to the study of issues related to the consideration of disputes on the protection of intellectual rights in courts of general jurisdiction. Special attention is paid to the issue of competence of courts of general jurisdiction in the field of protection of intellectual rights, as well as the analysis of materials of judicial practice, by the example of which the problems associated with the protection of intellectual rights are studied. The main objectives of the work are: to determine the general characteristics of intellectual rights, as well as to identify the main types of intellectual rights; to study the legal regulation of intellectual rights under Russian legislation and international norms; to determine the competence of courts of general jurisdiction in resolving disputes on the protection of intellectual rights, to identify the peculiarities of consideration of cases on the protection of copyright, related rights and other intellectual rights; to analyze the judicial practice of consideration of cases related to the violation of intellectual rights; to analyze the judicial practice of consideration of cases on the protection of intellectual rights; to analyze the legal regulation of intellectual rights in the Russian legislation and international norms. The analysis of legislative gaps and problems of law enforcement practice is carried out, on the basis of which the prospects of development of the institute of judicial protection of intellectual rights are considered.
