Целью работы исследование практики применения специальных экономических знаний при оценке деятельности контрагентов в арбитражном процессе и разработка рекомендаций по повышению эффективности данной деятельности в рамках Отдела экономической безопасности ООО «Газпром инвест». Были решены следующие задачи: - рассмотрена сущность споров организаций с контрагентами; - изучена статистика, касающаяся споров, рассматриваемых арбитражными судами; - проанализирована судебная практика; - дана оценка эффективности работы Отдела экономической безопасности ООО «Газпром инвест»; - предложены меры безопасности, позволяющие сократить количество случаев нарушения договорных обязательств со стороны контрагентов. Анализ и обработка данных осуществлялась с использованием программы MicrosoftOfficeExcel, для изучения нормативно-правовой базы – программа Консультант-Плюс, для изучения контрагентов – программа СПАРК. Актуальность темы обусловлена необходимостью комплексного использования результатов анализа финансово-хозяйственной деятельности контрагентов не только на стадии заключения договоров, но и в рамках судебных разбирательств. Источниками информации выступили данные отечественной и зарубежной научно-исследовательской литературы и официальных Интернет-ресурсов. Предложено внесение изменений в Положение о закупках Общества, реализуемых в рамках Федерального закона № 223-ФЗ, и предусматривающих обязательный учёт финансового состояния контрагентов при принятии решения о выборе победителя закупочной процедуры и отказ от безусловного приоритета минимальной цены при выборе победителя закупки.

The purpose of the paper is to study the practice of applying specialized economic knowledge in assessing the activities of counterparties in the arbitration process and to develop recommendations for improving the effectiveness of this activity within the Economic Security Department of Gazprom Invest LLC. The following objectives were achieved in the course of the study: - the essence of disputes between organizations and their counterparties was examined; - statistical data related to disputes considered by arbitration courts were analyzed; - judicial practice was examined; - the effectiveness of the Economic Security Department of Gazprom Invest LLC was assessed; - security measures aimed at reducing the number of cases of breach of contractual obligations by counterparties were proposed. Data analysis and processing were carried out using Microsoft Office Excel; the regulatory and legal framework was studied using the Consultant Plus information system; counterparty analysis was conducted using the SPARK system. The relevance of the topic is due to the need to comprehensively use the results of the analysis of the financial and economic activities of contractors, not only at the stage of concluding contracts, but also during legal proceedings.The sources of information included data from domestic and foreign scientific literature, official Internet resources, and analytical agencies. Amendments to the Company’s Procurement Regulation are proposed, implemented within the framework of Federal Law № 223-FZ, providing for the mandatory consideration of the financial condition of counterparties when deciding on the winner of a procurement procedure and the rejection of the unconditional priority of the lowest price in selecting the procurement winner.
